Terms of service

NUBE’s Responsibility

Service Management and Customer Protection:

  • NUBE Co. provides an international B2C subscription-based export service for Japanese facial masks. We are committed to selecting quality products, managing packaging, coordinating shipments, and delivering boxes directly from Tokyo to end consumers worldwide.

  • We are responsible for the products from the moment they are processed at our distribution center. In the event of unforeseen circumstances, we prioritize customer protection. However, NUBE Co. is not responsible for actions taken by third-party suppliers, such as production delays or discrepancies between product descriptions and actual characteristics. Our team will work to resolve any issues, including contacting suppliers when necessary, although we do not guarantee specific outcomes.

  • Our company does not assume responsibility for damage or loss during international transportation. However, in cases of common incidents occurring in transit, we will seek to offer limited compensation up to the original value of the affected products. We are not responsible for delays caused by customs procedures in the destination country, nor for errors in information provided by the customer (such as incorrect addresses or incomplete details).

  • If NUBE Co. is directly responsible for damage to or loss of products, we will refund the customer for such losses. The maximum refund amount shall not exceed the commercial value of the purchased products.

  • We continuously strive to improve our automatic translation system; however, we are not responsible for any misunderstandings resulting from automatic translations of product descriptions. If you have any questions regarding a product description, please contact our customer support team. We are not responsible for actions taken by third parties who access your account with or without authorization.

International Shipping:

  • Shipping costs are calculated based on the total weight of the products and the destination country. In general, the more products you order or the farther the destination, the higher the shipping cost.

  • Orders are dispatched within 3 to 4 business days after confirmation of payment for both the products and shipping. All orders from our online store are shipped directly from Tokyo, Japan.

  • Delivery times vary depending on the destination country and typically range from 5 to 14 business days. However, depending on the destination, customs procedures, or other factors, delivery may take longer.

  • Packages are shipped strictly in order according to order number and payment confirmation date. This ensures fair treatment for all customers.

  • To proceed with shipment, we require your confirmation of the total invoiced amount.

  • Shipping documentation will declare the contents as “merchandise” and will include the actual purchase value. By law, we cannot undervalue shipments or declare them as “gifts.” We regret that we cannot accommodate such requests and appreciate your understanding.

  • Under normal circumstances, transit time via Japan Post or FedEx is approximately two weeks. However, depending on the destination, customs procedures, or other factors, delivery may take up to one to two months. We recommend planning accordingly.

  • Depending on the laws of your country, your order may be subject to import taxes upon arrival at local customs. If you are concerned about potential additional charges, we recommend reviewing your country’s import regulations before placing an order. Such charges are the responsibility of the recipient and are not included in the purchase or shipping price.

Product Quality:

  • We work with certified suppliers in Japan to ensure quality standards. However, we are not responsible for allergic reactions or side effects resulting from the use of the masks, as these depend on each user’s individual conditions.


Account Security:
・Customers are responsible for maintaining the confidentiality of their account and password. We are not responsible for unauthorized access to accounts resulting from user negligence.

User Agreement and Terms of Service

Introduction

NUBE Co., a company registered in Japan that provides shopping-by-intermediation services through the official NUBE website (the “Website”), hereby enters into this Agreement with any legally independent adult (the “User”) who uses the Website and related services (the “Website”). This Agreement constitutes an official public offer addressed to individuals who wish to use NUBE’s services

 

SECTION 1. PURPOSE OF THE AGREEMENT

  1. NUBE makes available to Users subscription-based services consisting of the periodic delivery of Japanese facial masks (hereinafter, the “Products”), which include:

  2. Receiving, preparing, and packaging the Products at NUBE’s logistics center (hereinafter, the “Center”) for international shipment.

  3. Dispatching the Products to the User via postal services, international courier services, or any other authorized transportation provider (hereinafter, the “Carriers”), with all associated costs borne by the User.

  4. NUBE shall charge the User fees for these services in accordance with the rates and subscription plans published on the official website (hereinafter, the “Website”).

  5. The User grants consent to NUBE to collect, store, process, and transfer personal data in accordance with the Privacy and Cookies Policy published on the Website.

  6. NUBE may engage third parties (logistics providers, payment gateways, etc.) for the proper performance of the obligations described herein.

    By registering on the platform and activating a subscription, the User fully accepts the terms of this Agreement, which may be unilaterally modified by NUBE. It is the User’s responsibility to periodically review updates posted on the Website.
     

SECTION 2. OBLIGATIONS OF THE PARTIES

NUBE:

  • Shall provide subscription services and international shipping in accordance with Section 1 and applicable Japanese law.

  • Shall not be required to provide additional evidence regarding its communications with suppliers, sellers, or carriers.

  • May offer complementary services (premium tracking, special packaging, consulting services, etc.), which may be subject to additional fees and availability.

 

The User:

  • Shall pay subscription fees, international shipping costs, commissions, taxes, customs duties, and any other related charges in a timely manner.

  • Shall provide accurate, complete, and up-to-date information (shipping address, plan preferences, payment details, etc.). The User is responsible for the accuracy of the information provided.

  • Shall verify import restrictions, customs regulations, and delivery conditions in the destination country (weight, volume, declared value, ingredients, etc.).

  • Acknowledges that certain products may be subject to import restrictions or prohibitions in their country, which releases NUBE from any related liability.

  • Is strictly prohibited from using products acquired through NUBE for the development, manufacture, or use of conventional weapons or weapons of mass destruction. The transfer, resale, or distribution of such products to third parties for these purposes is also strictly prohibited. If NUBE determines that there are concerns regarding potential violations of this policy, it reserves the right to restrict the purchase and international shipment of the products in question.

 

SECTION 3. SUBSCRIPTION SERVICE PROCEDURES

A. PLACING AN ORDER

  • The User may subscribe through the Website by selecting an available subscription plan (quarterly, semiannual, or annual).

  • When using a credit card issued outside the United States, all charges will be processed in U.S. dollars (USD), and the amount will be converted to the local currency based on the exchange rate set by the card issuer and charged to the cardholder. Please note that some card issuers may apply additional fees and that transactions may take several hours or longer to appear on your account. Payments made via PayPal will be billed in U.S. dollars.

  • Once payment is confirmed, NUBE will process the order and schedule the delivery of the mask boxes from Japan to the designated address.

B. SUBSCRIPTION TERM AND RENEWAL

  • Subscription plans automatically renew at the end of the contracted period unless the User requests cancellation at least ten (10) business days in advance.

  • The User may cancel automatic renewal at any time through their account on the Website.

C. DELIVERY AND STORAGE

  • NUBE shall ship the boxes within the timeframes established under the contracted plan.

  • If a package is held by customs authorities, the User shall be responsible for handling procedures, taxes, and any associated charges.

D. NON-PAYMENT AND SERVICE SUSPENSION

  • If payment is not processed correctly or on time, the subscription may be suspended or canceled.

  • NUBE shall not be liable for subscription interruptions caused by insufficient funds, credit/debit card errors, or payment gateway rejections.

E. LIMITATION OF LIABILITY

  • NUBE shall not be liable for delays caused by third-party carriers, customs procedures, or force majeure events.

  • NUBE’s maximum liability shall be limited to the amount actually paid by the User under the active subscription.

F. INTERNATIONAL DELIVERY OF PRODUCTS

  • International delivery of subscription boxes shall be carried out through the Carriers indicated on the Website (Japan Post, FedEx, or other available providers).

  • Delivery costs are calculated based on the weight and dimensions of the package. Any additional charges arising from customs regulations, taxes, or duties in the destination country shall be the sole responsibility of the Client.

  • NUBE’s service shall be deemed completed once the box is handed over to the Carrier in Japan. NUBE has no control over transit times or customs procedures, which may vary by destination country.

  • NUBE shall not be liable for delays, damage, or loss caused by Carriers or customs authorities; however, it will provide reasonable assistance to the Client in filing claims when applicable.

G. CANCELLATION, SUSPENSION, AND REFUND CONDITIONS

Subscription Cancellation

  • Upon completion of the contracted period, the subscription will automatically terminate. Subscription plans do not renew automatically. Once the current plan has started, the subscription cannot be interrupted until its completion.

  • At this time, subscriptions cannot be paused or suspended.

  • Please note that all payments made for boxes and services are final and non-refundable.

Non-Refundable Products

  • For hygiene, safety, and sanitary control reasons, Products (facial masks) are non-returnable and non-refundable once shipped.

  • Returns will not be accepted for minor variations in packaging or design, provided that product quality is not affected.

Refund Exceptions:

  • Refunds may be requested only in the following cases:

  • Refunds will be issued solely in the event of an error attributable to NUBE (e.g., incorrect shipment, verifiable manufacturing defects).

Force Majeure and Third-Party Liability

  • NUBE shall not be liable for delays, losses, or damages caused by external factors such as customs actions, sanitary holds, natural disasters, transportation strikes, pandemics, or other force majeure events.

  • In such cases, refunds will not be issued, although NUBE may offer alternative solutions at its discretion (partial replacement shipment, subscription extension, etc.).

Modification of Subscription Products

  • NUBE may adjust the selection of Products within the boxes based on availability while maintaining equivalent quality and characteristics. Such changes shall not constitute grounds for returns or early cancellation.

Refund of Advance Payments

  • In the case of semiannual or annual subscriptions canceled early by the User, payments already made shall not be refunded, except in the exceptional cases described above.

 

H. ACCOUNT DELETION AND DENIAL OF SERVICES

  1. The Client may request account deletion at any time, provided there are no outstanding payments or scheduled shipments.

  2. NUBE may suspend or cancel the Client’s account in the event of:

  • Repeated non-payment or unjustified charge disputes.

  • Misuse of the service, including fraud attempts or use of stolen cards.

  • Disrespectful communication, threats, or conduct affecting NUBE staff.

  • Violation of the established policies, terms, and conditions.

    Account deletion results in the automatic cancellation of any active subscription plan, with no right to a refund for unused periods, except in cases of error attributable to NUBE.

 

SECTION 4. LIMITATION OF LIABILITY AND FORCE MAJEURE

  1. Extraordinary Events: NUBE shall not be liable for any failure to perform its obligations arising from extraordinary circumstances beyond its reasonable control, including, but not limited to, natural disasters, wars, armed conflicts, epidemics, governmental actions, strikes, or interruptions to international transportation.
     

  2. Product Liability: NUBE acts solely as a distributor of cosmetic face masks manufactured by third parties in Japan. Responsibility for the composition, quality, safety, health certifications, labeling, or effects of the products rests exclusively with the manufacturers. NUBE does not guarantee any results derived from the use of the products.
     

  3. NUBE Services: NUBE shall be responsible only for services related to the selection, storage, packaging, and international shipment of the products, as set forth in this Agreement.
     

  4. Third Parties: NUBE assumes no responsibility for the acts or omissions of third parties, including manufacturers, shipping providers, customs authorities, banks, and payment systems. The Client acknowledges that NUBE shall not be liable for losses, delays, additional costs, or damages caused by such third parties.
     

  5. Limitation of Damages: NUBE’s liability to the Client shall be strictly limited to the value of the contracted service. In the event it is proven that NUBE personnel have directly committed an error resulting in damage or loss, the maximum compensation shall be limited to the value of the affected product or service.
     

  6. Legal Compliance: NUBE does not verify or guarantee that the products comply with the health, customs, or import regulations of the destination country. It is the sole responsibility of the Client to ensure that the importation of the products is lawful in their jurisdiction and to comply with any applicable restrictions or requirements.
     

  7. Exclusion of Liability: NUBE shall not be liable for:

  • Delays in delivery caused by international carriers.

  • Indirect or consequential damages, loss of profits, or loss of business opportunity.

  • Inaccurate translations of product descriptions provided by the manufacturers.

  • Any waiver of liability regarding the outcome of negotiations with the Supplier in the event the Client contacts the Supplier directly.

 

SECTION 5. DISPUTE RESOLUTION

Prior Negotiation: Any dispute related to this Agreement, NUBE’s services, or the distributed products shall first be attempted to be resolved through direct, good-faith negotiation between the parties.
Applicable Jurisdiction:

  • Disputes in which NUBE is the defendant shall be resolved under the jurisdiction of the courts of Tokyo, Japan, and in accordance with Japanese law.

  • In cases where the Client is the defendant, the dispute may be resolved in the Client’s local jurisdiction, unless local law provides otherwise.

    Binding Nature: By accepting this Agreement, the Client acknowledges that the terms set forth herein are legally binding and constitute the governing framework of the contractual relationship with NUBE.
